A new law in California prohibits the sharing of sex tapes or nudes of exes without their consent. However, attorney David Pisarra, explained to Hollywoodlife.com that there could be loopholes that will allow Tyga release the tape and get away with it.
“There are several legal loopholes Tyga could jump through if he wanted to release a sex tape with his ex gf Kylie Jenner without getting into too much trouble and perhaps even make a few dollars in the process.
One way around the revenge sex porn law would be if Tyga did not release the tape himself. If he could claim in court that he accidentally left a laptop with the sex tape on it out in his house, and he had a small party at his house where a stranger had access to the computer.
Tyga could claim a stranger then posted the video without Tyga’s knowledge. Tyga must prove that he did not intend for the tape to be released. Intent is key.”
“Once the tape gets accidentally leaked, Tyga could sue whoever may profit from the release, claiming copyright law because he filmed the tape and then get money from the tapes release,” the lawyer continued.
“As long as Tyga can express plausible deniability, that he had no idea the tape was to be released, he may be able to avoid civil prosecution. Once he profits from the tape, then Kylie can come after Tyga for damages and he may have to share profits. But at that point, the tape is out and the damage is done.”
